Definition : Cadastre of Quebec

Public Register of the State, under the responsibility of the Department of Natural Ressources [ministère des Ressources naturelles(MRN)], representing on a plan, prepared by a land surveyor, private immovable properties. It thus has for object to establish the partition of the Quebec territory  between each of the properties composing it, by the attribution thereto of a distinct lot number (comprising 7 numbers). Furthermore, the measurements and area of each lot is indicated therein along with their position relative to neibouring properties. This plan is deemed exact and is kept at the Land registry office  for the registration division  in which the immovable concerned by this plan are situated. This register can be consulted online on the government website Info-lot.

Whether you are a real estate developer (for a new building) or several owners of an existing building who wish to convert it, the rules for subjecting a building to divided co-ownership are the same. The creation of a divided co-ownership is necessary when an immovable must be divided into lots composed of a private portion and a share  of the common portions, and which belong to one or more different persons. The community of co-owners acquires the status of legal person from the day a declaration of co-ownership is published at the Land registry office (Land Register). The legal person thus constituted takes the name of “syndicate of co-owners”. Its mission is to ensure the " preservation of the immovable, the maintenance and administration of the common portions, the protection of the rights appurtenant to the immovable or the co-ownership, as well as all business in the common interest ". The characteristic of divided co-ownership is to divide the building into various lots that will be the exclusive property of the co-owners (private portions), and for others that will be the property of all the co-owners (common portions). These lots are identified by an individual number, which was assigned during the cadastral operation. Each of the private lots of the co-ownership thus constituted becomes a unique property. The distinction between the common and private portions is essential, particularly from the point of view of maintenance, which is the responsibility of the syndicate of co-owners for the common portions and of the co-owners for the private portions.
